Terms of Service for UNWONTED Online Store

PRELIMINARY PROVISIONS - YOUR RIGHTS
Right to Individual Negotiation: Before placing an order, you have the right to negotiate any provisions of this contract with us, including amendments to these Terms of Service. To initiate negotiations, please contact us at info@unwonted.dkbefore completing your purchase.
If you choose not to negotiate individual terms, the following standard Terms of Service and applicable law shall apply to your purchase.
§ 1. DEFINITIONS
For the purposes of these Terms of Service, the following definitions apply:

Account - a free electronic service enabling the Customer to use additional functionalities of the Online Store, including order history, saved addresses, and preferences.

Business Days - Monday through Friday, excluding Polish public holidays and bank holidays.

Consumer - a natural person making a purchase for purposes not directly related to their business or professional activity.

Customer/You - any natural person with legal capacity visiting the Online Store or placing an Order.
-
Delivery Address - the physical address or collection point specified by the Customer for Product delivery.
-
Digital Content - data produced and delivered in digital form.
-
Durable Medium - material or device enabling storage of information in a way allowing future access for a period adequate to the purposes of the information (e.g., email, PDF).

Electronic Service - services provided electronically by the Seller through the Online Store (e.g., Account, Newsletter, Order Form).

Newsletter - an electronic service allowing subscription to marketing communications about our products and farm stories.

ODR Platform - the EU Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr

Online Store/Store/Website - our e-commerce website available at www.unwonted.dk and related subdomains.

Order - the Customer's declaration of will aimed directly at concluding a Sales Agreement, specifying Products, quantities, delivery method, and payment method.

Order Confirmation - the Seller's electronic declaration accepting the Order and confirming conclusion of the Sales Agreement.

Order Form - the electronic service enabling Order placement.

Privacy Policy - the document describing how we process personal data, available at www.unwonted.dk/privacy-policy

Product - movable goods (alpaca duvets, pillows, and related items) available for purchase in the Online Store.

Proof of Purchase - invoice, receipt, or order confirmation issued in accordance with applicable tax laws.

Registration Form - the electronic form for creating an Account.

Sales Agreement/Contract - the agreement for sale of Products concluded between Customer and Seller through the Online Store.

Seller/We/Us/UNWONTED - UNWONTED sp. z o.o., a limited liability company registered in Poland, with registered office at ul. Słoneczna 2, 83-332 Dzierżążno, Poland, entered in the National Court Register under number [KRS]0001148467, Tax ID (NIP): 5892097950

Service Provider - UNWONTED sp. z o.o. in its capacity as provider of Electronic Services.

Shopify - Shopify Inc., the provider of the e-commerce platform powering our Online Store.

System - the set of cooperating IT devices and software enabling the Online Store's operation.

Terms/Terms of Service/Regulations - this document.

Withdrawal Period - the 14-day period during which EU Consumers may withdraw from the Sales Agreement without stating reasons.
§ 2. GENERAL PROVISIONS

2.2 Scope and Acceptance

These Terms govern all Sales Agreements concluded through our Online Store.

By placing an Order, you confirm that you have read, understood, and accepted these Terms.

The Sales Agreement is concluded in Polish and/or English according to your preference.

We provide Electronic Services and sell Products exclusively to Consumers (not for business purposes).

All prices include applicable VAT. Additional costs (shipping, customs for non-EU) are specified before Order completion.

Products are delivered only to addresses within our specified delivery areas.
2.3 Technical Requirements
To properly use our Online Store, you need:

Device with internet access (computer, tablet, or smartphone)

Updated web browser (Chrome 90+, Firefox 88+, Safari 14+, Edge 90+)

JavaScript and cookies enabled

2.4 Prohibited Uses
You may not use our Online Store to:

Provide false or misleading information

Violate any laws or third-party rights

Transmit harmful content or malware

Interfere with the Store's operation

Engage in fraudulent activities

Resell products without authorization
§ 3. ELECTRONIC SERVICES
3.1 Available Services
We provide the following Electronic Services free of charge:

Order Form (enables purchase)

Account (stores order history and preferences)

Newsletter (marketing communications)

Product availability notifications
3.2 Account Registration

Registration requires: name, email address, password, and optional delivery address.

You must protect your login credentials and notify us of any unauthorized access.

Account registration is optional; purchases can be made as a guest.

We may terminate accounts that violate these Terms with 14 days' notice.
3.3 Newsletter

Newsletter subscription requires only an email address.

You can unsubscribe anytime via the link in each newsletter or through your Account.

We send newsletters maximum twice per week.

§ 4. SALES AGREEMENT CONCLUSION
4.1 Product Information

Product descriptions, including main characteristics and price, are provided on each Product page.

Product images are for illustration. Actual products may vary slightly due to:

Photography and display differences

Each Product includes care instructions and material composition.
4.2 Ordering Process
To place an Order:

Accept these Terms

This constitutes your offer to purchase.
4.3 Order Confirmation

After placing your Order, you'll receive an automatic acknowledgment email.

We review Orders within 48 Business Hours.

The Sales Agreement is concluded when we send Order Confirmation.

We reserve the right to reject Orders in cases of:

Obvious pricing errors

Product unavailability
-
Invalid payment

Delivery restrictions

If we reject your Order, any payments will be refunded within 7 days.
- For duvet purchases, account registration is recommended to activate your Lifetime Guarantee
4.4 Order Modifications
Orders cannot be modified or cancelled after Order Confirmation, as production begins immediately.
§ 5. PRICES AND PAYMENT
5.1 Pricing

Danish Kroner (DKK) for Denmark

Euro (EUR) for all other European countries

All prices include VAT at applicable rates.

Shipping costs are calculated at checkout based on delivery location.

Total price (Products + shipping) is clearly shown before Order completion.

5.3 Payment Processing

Card payments are processed immediately upon Order placement.

Bank transfers must be completed within 3 Business Days.

Orders paid by bank transfer are processed after payment confirmation.

We do not store credit card details; all payment processing is secure.
§ 6. DELIVERY
6.1 Delivery Areas

6.3 Delivery Process

You'll receive tracking information when your Order ships.

Someone should be available to receive delivery at the specified address.

If delivery fails, the carrier will attempt redelivery or leave instructions.

Risk of loss passes to you upon delivery to the carrier.
6.4 Inspection Upon Delivery

Inspect packages for visible damage before accepting.

Note any damage on carrier's documents.

Report damage to us within 48 hours with photos.
§ 7. CONSUMER RIGHTS AND RETURNS
7.1 Statutory Right of Withdrawal (14 Days)
For EU Consumers only:

You have 14 days to withdraw from the Sales Agreement without giving reasons.

The period starts when you receive the Products.

To withdraw, send an unequivocal statement to info@unwonted.dk

You may use the model withdrawal form (Appendix 1) but it's not obligatory.
Effects of Withdrawal:

Return Products within 14 days of withdrawal notice

We refund all payments (except additional delivery costs) within 14 days

We may withhold refund until receiving Products or proof of return
-
You bear return shipping costs (except for defective Products)
-
You're liable for diminished value from handling beyond what's necessary
Exceptions to Withdrawal Right:

Products made to your specifications

Sealed products that cannot be returned for hygiene reasons after opening

Products that deteriorate rapidly
7.2 UNWONTED Extended Return Policy (30 Days)
Beyond legal requirements, we offer:

30 days from delivery to return Products

Products must be unused, with tags, in original packaging
-
We provide free return labels for European returns
-
Full refund minus original shipping (if applicable)
7.3 How to Return

Initiate return of the product through your account

Email info@unwonted.dk with Order number and reason

Receive return authorization and label

Package Products securely in original packaging

Ship within 7 days of authorization

Refund processed within 14 days of receipt
§ 8. WARRANTY AND COMPLAINTS
8.1 Legal Warranty (Rękojmia)

Products are covered by statutory warranty under Polish Civil Code (Articles 556-576).

We're liable for defects existing at delivery time.

Warranty period: 2 years from delivery (1 year for used items).

Request repair or replacement

Withdraw from contract (for significant defects)

8.2 Filing a Product Complaint

We respond within 14 days; no response means acceptance
8.3 CRAFTSMANSHIP GUARANTEE
UNWONTED guarantees every alpaca duvet against defects in materials and craftsmanship for five years from the date of purchase. If a verified manufacturing defect appears within that period, we will replace the duvet, subject to stock availability. Where current stock is unavailable, your replacement is given priority placement in our next production cycle.
What's covered Stitching integrity, seam construction, shell fabric defects not caused by misuse, and fill clumping or shifting that affects the duvet's performance under normal use.
What's not covered Natural aging of materials, stains, discolouration, cosmetic wear from regular use, damage caused by pets, children, or accidents, and damage resulting from misuse or improper care.
Activation The guarantee is activated automatically when you complete your purchase through a registered account on unwonted.dk. For duvets purchased through authorised retailers, please retain your receipt as proof of purchase.
This guarantee applies exclusively to UNWONTED alpaca duvets and does not affect your statutory rights under Danish or EU consumer law.
§ 9. SHOPIFY PLATFORM
9.1 Platform Provider

Our Online Store operates on the Shopify e-commerce platform.

Shopify Inc. provides technical infrastructure but is not party to your Sales Agreement.

All purchases are made directly from UNWONTED sp. z o.o.
9.2 Shopify Services
When you use our Store, you may interact with Shopify services:

Shopify Payments (payment processing)

Shop App (order tracking, Shop Pay)
-
Shopify Email (marketing communications)
-
Shopify Analytics (anonymized usage data)
9.3 Data Processing

Shopify processes data as our processor under GDPR.

Some features involve Shopify as independent controller.

9.4 Liability Disclaimer

Shopify is not responsible for:

Product quality or descriptions

You release Shopify from all claims related to purchases.

All purchase-related matters are between you and UNWONTED.
9.5 Technical Issues
For Shopify platform technical issues:

We'll work to resolve them promptly

Alternative ordering methods may be provided

No liability for temporary unavailability
§ 10. PERSONAL DATA PROTECTION
10.1 Data Controller
UNWONTED sp. z o.o. is the Personal Data Controller.
10.2 Data Processing

We process data according to GDPR and our Privacy Policy.

Providing data is voluntary but necessary for Orders.

You have rights to access, correct, delete, and port your data.
10.3 Cookies
Our Store uses cookies for:

Essential functions (cart, checkout)

Analytics (understanding usage)

Marketing (if consented)

§ 11. INTELLECTUAL PROPERTY
11.1 Ownership
All content in our Online Store is owned by UNWONTED or licensed to us, including:

Logos, trademarks, trade names

Product descriptions and farm stories

Website design and layout
11.2 Limited License
You may view and print content for personal, non-commercial use only.
11.3 Prohibited Uses
You may not without written permission:

Copy, reproduce, or distribute our content

Create derivative works

Use content for commercial purposes

Remove copyright notices
§ 12. LIABILITY
12.1 Our Liability

We're liable under statutory provisions for damages caused intentionally or by gross negligence.

For simple negligence, we're liable only for:

Injury to life, body, or health

Breach of essential contractual obligations

Liability is limited to typical, foreseeable damages.
12.2 Limitations
We're not responsible for:

Indirect or consequential damages

Lost profits or opportunities

Third-party carrier delays

Force majeure events
12.3 Consumer Rights
These limitations don't affect mandatory consumer rights under law.
§ 13. DISPUTE RESOLUTION
13.1 Amicable Resolution
We prefer to resolve disputes amicably. Contact us first at info@unwonted.dk.
13.2 Alternative Dispute Resolution (ADR)
EU Consumers may use:

13.3 Applicable Law

Polish law governs these Terms.

13.4 Jurisdiction

Consumers may bring claims in their local courts or Polish courts.

We may bring claims only in Consumer's local courts.
§ 14. FINAL PROVISIONS
14.1 Amendments

We may amend these Terms for important reasons:

Legal changes

Platform updates

Service improvements

Amendments are announced 14 days before taking effect.

Amendments don't affect existing Orders.
14.2 Severability
If any provision is invalid, other provisions remain in effect.
14.3 Entire Agreement
These Terms, Privacy Policy, and Order Confirmation constitute the entire agreement.

14.6 Language
These Terms are available in Polish and English. In case of discrepancy, the Polish version prevails.
